Welcome to the Medical Cannabis Association of North Dakota!

We hope you enjoy your learning experience! Please help us educate others!

The MCAND is an organization to promote the efficacy of cannabis as medicine and to advocate enacting "Medical Marijuana Laws in North Dakota". We are compassionate people here in North Dakota. This organization believes it unjust to be jailing our sick and ailing neighbors for using this natural plant as medicine. Pharmaceutical drugs are killing people on a grand scale each year. Cannabis has never killed anyone in history. People with MS, Cancer, AIDS, and many other ailments are put in jail here in ND if they use cannabis as medicine. We wish to change that. Twelve states have enacted medical marijuana laws and regulations now that are working well Alaska, California, Colorado, Hawaii, Maine, New Mexico, Montana, Nevada, Oregon, Rhode Island, Vermont and Washington have stopped using State Tax dollars to arrest patients. There are many more cities and states filing initiatives, including South Dakota, Minnesota, Illinois, Connecticut, Michigan and New York. Since Canada enacted laws in 1998, when SD and MN enact medical marijuana laws (as they will), North Dakota will be surrounded by compassionate people who believe in this plant as a living medicine. We at the Medical Cannabis Association of North Dakota believe that the people of North Dakota are no less compassionate or intelligent than the people in these states. I found some highly offensive posts in the forums today and had to remove them. We are NOT interested in Viagra or any Adult material or drugs.

Unfortunately, due to this type of activity, I had to make the forums for Registered Users Only and I will be Monitoring each topic, so all messages must come through me. We can expect more of this type of thing as time goes on and we become more well known. There are many jouvenile people who do not agree with our message and want to do nothing more than to create problems for us. As if we need More problems.

I would like to draw your attention to Section 2 and ask; Isn't it time to change the marijuana laws in ND?

                             ARTICLE I

 
                             DECLARATION OF RIGHTS
 

Sec. 1.   All men are by nature equally free and independent and  have

          certain inalienable rights,  among which are  those enjoying

          and defending  life and  liberty; acquiring,  possessing and

          protecting property and reputation; and pursuing and obtain-

          ing safety and happiness.

 

Sec. 2.   All political  power is inherent in the people.   Government

          is instituted  for the  protection, security  and benefit of

          the people,  and they  have a  right to  alter or reform the

          same whenever the public good may require.

 

Sec. 3.   The  state of  North  Dakota  is an  inseparable part of the

          American union  and the  constitution of  the United  States

          is the supreme law of the land.

 

Sec. 4.   The free exercise and enjoyment of religious profession  and

          worship, without discrimination or preference, shall be for-

          ever guaranteed in this state,  and no person shall be  ren-

          dered incompetent to be a witness or juror on account of his

          opinion on matters of  religious belief; but the  liberty of

          conscience hereby secured  shall not be  so construed as  to

          excuse acts of  licentiousness, or justify  practices incon-

          sistent with the peace and safety of this state.

 

Sec. 5.   The privilege of the writ of habeas corpus shall not be sus-

          pended unless, when  in case of  rebellion or invasion,  the

          public safety may require.

 

Sec. 6.   All persons shall be bailable by sufficient sureties, unless

          for capital offenses when the  proof is evident or the  pre-

          sumption great.  Excessive bail  shall not  be required, nor

          excessive fines imposed, nor shall cruel or unusual  punish-

          ments be  inflicted.   Witnesses shall  not be  unreasonably

          detained, nor be  confined in any  room where criminals  are

          actually imprisoned.

 

Sec. 7.   The right of trial by jury shall be secured to all, and  re-

          main inviolate; but a jury in civil cases, in courts not  of

          record may consist of less  than twelve men, as may  be pre-

          scribed by law.

 

Sec. 8.   Until  otherwise  provided  by law,  no person  shall, for a

          felony, be prosecuted against criminally, otherwise than  by

          indictment, except in  cases arising in  the land and  naval

          forces, or in the militia when in actual service in time  of

          war or public danger.  In all other cases, offenses shall be

          prosecuted  criminally  by  indictment  or information.  The

          legislative  assembly  may  change,  regulate or abolish the

          grand jury system.

 

Sec. 9.   Every man  may freely write, speak and publish  his opinions

          on all  subjects, being  responsible for  the abuse  of that

          privilege. In all  civil and criminal  trials for libel  the

          truth may be  given in evidence,  and shall be  a sufficient

          defence when the matter  is published with good  motives and

          for justifiable ends; and the jury shall have the same power

          of giving a  general verdict as  in other cases;  and in all

          indictments or informations for  libels the jury shall  have

          the  right  to  determine  the  law  and the facts under the

          direction of the court as in other cases.

 

Sec. 10.  The citizens have a right, in a peaceable manner, to  assem-

          ble together for the common good, and to apply to those  in-

          vested  with  the  powers  of  government for the redress of

          grievances, or for other  proper purposes, by petition,  ad-

          dress or remonstrance.

 

Sec. 11.  All laws of a general nature shall have a uniform operation.

 

Sec. 12.  The  military shall be subordinate  to the civil power.   No

          standing army shall be maintained  by this state in time  of

          peace, and no soldiers shall, in time of peace, be quartered

          in any house without the  consent of the owner; nor  in time

          of war, except in the manner prescribed by law.

 

Sec. 13.  In criminal  prosecutions  in any court  whatever, the party

          accused shall have the right  to a speedy and public  trial;

          to have the process of the court to compel the attendance of

          witnesses in his behalf; and to appear and defend in  person

          and with counsel. No person  shall be twice put in  jeopardy

          for the same offense, nor be compelled in any criminal  case

          to be a  witness against himself,  nor be deprived  of life,

          liberty or property without due process of law.

 

Sec. 14.  Private  property shall not be  taken or damaged for  public

          use without just compensation having first been made to,  or

          paid into court  for the owner.   NO right of  way shall  be

          appropriated to the use  of any corporation until  full com-

          pensation therefor be first made in money or ascertained and

          paid into court for  the owner, irrespective of  any benefit

          from  any  improvement  proposed  by such corporation, which

          compensation shall be ascertained  by a jury, unless  a jury

          be waived, provided however, that  when the state or any  of

          its departments, agencies or political subdivisions seeks to

          acquire right of way, it may take possession upon making  an

          offer to purchase and by depositing the amount of such offer

          with the clerk of the  district court of the county  wherein

          the right of  way is located.   The clerk shall  immediately

          notify  the  owner  of  such  deposit.   The owner thereupon

          appeal to the court in  the manner provided by law,  and may

          have a jury trial, unless a jury be waived, to determine the

          damages

 

Sec. 15.  No person shall  be imprisoned for debt unless upon  refusal

          to deliver up his estate  for the benefit of his  creditors,

          in such manner as shall be prescribed by law; or in cases of

          tort; or where there is strong presumption of fraud.

 

Sec. 16.  No  bill of attainder, ex  post facto law, or  law impairing

          the obligations of contracts shall ever be passed.

 

Sec. 17.  Neither slavery  nor  involuntary servitude, unless  for the

          punishment of crime, shall ever be tolerated in this state.

 

Sec. 18.  The  right  of the  people to  be secure  in their  persons,

          houses, papers  and effects,  against unreasonable  searches

          and seizures  shall not  be violated;  and no  warrant shall

          issue  but  upon  probable  cause,  supported  by  oath   or

          affirmation,  particularly  describing   the  place  to   be

          searched and the person and things to be seized.

 

Sec. 19.  Treason against the state shall consist only in levying  war

          against it, adhering to its  enemies or giving them aid  and

          comfort. No person shall  be convicted of treason  unless on

          the evidence  of two  witnesses to  the same  overt act,  or

          confession in open court.

 

Sec. 20.  No special  privileges  or immunities shall  ever be granted

          which may not be altered, revoked or repealed by the  legis-

          lative assembly; nor shall any citizen or class of  citizens

          be  granted  privileges  or  immunities  which upon the same

          terms shall not be granted to all citizens.

 

Sec. 21.  The provisions  of this constitution are mandatory  and pro-

          hibitory unless, by express  words, they are declared  to be

          otherwise.

 

Sec. 22.  All courts shall be open, and every man for any injury  done

          him in his  lands, goods.   person or reputation  shall have

          remedy by due process of law, and right and justice adminis-

          tered without sale,  denial or delay.  Suits may be  brought

          against the  state in  such manner,  in such  courts, and in

          such cases, as the legislative assembly may, by law, direct.

 

Sec. 23.  Every citizen of this state shall be free to obtain  employ-

          ment  wherever  possible,  and  any  person, corporation, or

          agent thereof, maliciously  interfering or hindering  in any

          way, any citizen from  obtaining or enjoying employment  al-

          ready obtained, from any other corporation or person,  shall

          be deemed guilty of misdemeanor.

 

Sec. 24.  To guard against transgressions of the high powers which  we

          have delegated, we declare  that everything in this  article

          is  excepted  out  of  the  general powers of government and

          shall forever remain inviolate.

Wow, amazing... i've finally found a path to wat i been serchin for online for bout a year now. let me start off by saying i am a medical cannibis user. I live in ND. and i have been diagnosed with a corneal degenerate disease called "Keratoconus" it's not too common of a disease. but anyway i started off my wearing double contact lenses one soft lense and a hard contact over the soft called the piggyback method by most eye dr.'s familiar wit KT (keratoconus)... this causes extreme irritation sometimes pain to have to be able to bear to keep the contacts in. also causes corneal abrasions ulcerations etc.. due to constant shifting of the two lenses acratchin the surface of my corneas. the reason for this is because my corneas are an irregular shape and intraocular pressure seems to always be at high as in most glaucoma patients. also with this ail ment comes double vision distortions halo's of light. bein almost unable to drive at night. (it is a challenge) over years my left eye was so scarred up from the contacts that i had to undergo a corneal transplant and post op i was prescribed a steroid eye drop that helps prevent rejection of the donor cornea. side effent of this drop is increase in intraocular pressure as well as it is already high. like covering a bandaid wit a band aid wit this medicatiions today lol. also i am almost destined to end up wit glaucoma in years to come as most KT patients do down the road. now i started using cannibis when talkin to an out of state opthamologist and he told me of medical cannibis and how it aids in decreasing corneal sensitivity enabling me to tolerate contact lense wear more in the right eye which i have to wear the double lenses still. and will obviously cut down the tear production which i have quite an excess of. in both eyes. also for some reason i acquire a better night time vision than i would when not using cannibis regularly. ultimately, it will basically reduce the pressure which is causing the protuding cornea thats already deteriorating(tissue wise) from bulging even more deceeding it and contacts stay in better move rub less scratch less etc.. now thes are all spec's i've learned from out of state eye dr's all over the US have confirmed the same to me. but when i bring it up to my present DR's in ND here they all basically just bow their heads turn the cheek or change the subject and just say thet they cannot back up or deny my claim that i present to them as i have in this email even with written proof from out of state DR's. i'm assumin that beings there no medicinal laws regardin use of cannibis in the state of ND that they fear legal consequences an reprocautions if back fired due to... there have NEVER been any studies wit the use of cannibis and KT to date that i am aware of but these findings are all results of other studies but yet similar conditions and how cannibis has same weilding effects wit patients wit other disorders such as glaucoma but are all similar and basic as pertaining to KT as it falls into a sister category to glaucoma. excuse my language here but... i have a snow balls chance in hell tryin to convince anyone on this and try to even present this to any elected official or people of society as my character standing probably would not stand up in anythin. wat i mean is i have spent time in state prison twice for non drug related offenses i am on probation for a nonrelated drug offense but yet i have a recorded cannibis use history as a teenager til i was bout 20. so of course many if not all will just assume i am just some punk trouble makin exconvict looking for a free ticket to smoke dope. as some would probly put it. i am all ears to wat u are doing here and am shocked that someoen in ND is actually starting to get with this day in age not like all these old fashioned believers that think cannibis is a drug and drugs are bad bit. if there is anything i can do to assist or help in any way feel free to hollar at me. also what can a person in my shoes do to stand up for myself in this society in ND... Basically i would love to move to any statre with medicinal laws and would be willing to do so as well but i am on probation and am not allowed to leave the state not can i move. tried already wont accept me. Please what can i do? wat steps does a person have to take etc... heck if ya need an assistant even I am ur man. i am a relentless determined person when its for somethin i feel strongly about and truly believe. i feel like i'm in a dark cave and cant see dont know where to go where to look wat to say etc.... SOS Thank-you for your time. i greatly appreciate it and look very forward to hearing back from u or whom ever in this matter. thank you. sincerely'

Realities of Cannabis Prohibition

As concerned citizens we despise drugs, as we should. We believe that we should do everything we can to criminalize them and their use with harsh penalties. This is the approach we have taken with cannabis for more than 70 years. The cannabis plant is as prevalent now as it was in 1776, when it was “illegal” NOT to grow it here. It’s been established by the government’s own data, that cannabis is in the top three cash crops in the USA, but how can that be? Since 1972 we have spent more than a trillion dollars, gone through 7 presidents, jailed more than twenty million people and it’s STILL in the top three? Last year alone we jailed over 800,000 people for drugs, 87% for cannabis possession alone. What’s wrong with this picture?

At this time 47 percent of the US population has smoked cannabis at some time and it’s estimated that more than twenty five million people use it regularly in this country. Compare the numbers for other drugs and that explains the drug war. If it weren’t for cannabis there would be no drug war. The worst part of this is that people who can benefit medically from this plant are persecuted and put in jail to die. It’s not bad enough that students loose college grants and don’t qualify for student loans, even though murderers get them, or that otherwise law abiding citizens have their children taken away, even though alcoholics don’t, or that hundreds of thousands of people have lost or are refused jobs when this isn’t true for alcoholics, but we still have to make sure that all the sick and dieing people who use cannabis as medicine are put in jail and refused treatment as well.

Yes, we hate drugs, but it’s time we understand the term “Harm Reduction”. We need to re-examine what we can do to remove as much harm from drugs as possible. Including the harm we cause. That’s real compassion. What can we do to start? How about removing those sick and dieing people who need cannabis as medicine from this Drug War? We need medical cannabis laws in North Dakota for two reasons. To show our population that we care for them and to show the Federal Government that there is one more state that supports the science of cannabis and not the politics.
